In plain English: We collect the information you give Inky so we can clean your photos, draft listings, help price items, and post listings to the marketplaces you choose. We do not sell your personal information. You can ask us to access, correct, export, or delete your information, subject to legal, security, and operational limits.

This Privacy Policy explains how AJH Gaming and Holdings LLC, a Missouri limited liability company (“Inky,” “we,” “us,” or “our”) collects, uses, discloses, stores, and protects information when you use Inky, our websites, apps, tools, and related services (collectively, the “Service”).

By using the Service, you acknowledge that you have read this Privacy Policy. If you do not agree with this Policy, do not use the Service.

1. Information we collect

We collect information you provide directly, information generated when you use the Service, and information we receive from service providers or marketplaces you choose to connect.

• Account information. This may include your name, email address, login credentials, account identifiers, authentication records, and related account settings. Login credentials may be handled by our authentication provider. We use access controls designed to keep account information separated from general app data where practical.
• Item photos and listing content. This includes photos you upload, image files, file metadata, item details, titles, descriptions, categories, prices, drafts, tags, notes, and other listing content that you create, upload, edit, or ask Inky to generate.
• Marketplace connection information. If you connect a marketplace account, we may collect and store the information needed to connect, authenticate, sync, draft, publish, update, or manage listings on that marketplace. This may include marketplace account identifiers, authorization tokens, posting permissions, listing status, listing IDs, API responses, and related marketplace activity.
• Usage, device, and log data. We may collect technical information such as IP address, browser type, device type, operating system, pages viewed, actions taken, referring URLs, timestamps, error logs, and security events.
• Cookies and similar technologies. We use cookies and similar technologies to keep you signed in, remember preferences, operate the Service, improve performance, and understand basic usage.
• Payment and subscription information. If you purchase a paid plan, our payment processor, Stripe, handles payment card details. We do not store full payment card numbers on our systems. We may receive limited billing information such as your name, email, billing address, subscription status, payment status, plan type, invoices, and transaction identifiers.
• Support and communications. If you contact us, we may collect your messages, contact details, attachments, and any other information you choose to provide.

2. How we use your information

We use your information to:

• Provide, operate, maintain, and improve the Service.
• Clean, edit, process, organize, and store item photos.
• Generate, revise, price, categorize, and manage item listings.
• Post, sync, update, or manage listings on marketplaces you select.
• Maintain your account, authenticate users, process subscriptions, and provide customer support.
• Communicate with you about your account, product updates, security, support, billing, and administrative matters.
• Monitor, secure, debug, and protect the Service, including preventing fraud, abuse, unauthorized access, and misuse.
• Analyze usage and improve features, reliability, user experience, and performance.
• Comply with legal obligations, enforce our terms, and protect the rights, safety, and property of Inky, our users, marketplaces, service providers, and the public.

We do not sell your personal information. We also do not use your private item photos or private listing content to train third-party AI models for purposes unrelated to providing the Service to you, unless you separately authorize that use.

3. AI processing

Some Service features may use artificial intelligence or machine learning providers to help clean images, generate listing drafts, suggest titles, descriptions, categories, prices, or other listing content. When you use those features, the content you submit may be processed by those providers solely to provide, secure, support, and improve the requested feature, subject to our agreements with them and their applicable terms.

AI-generated output may be inaccurate, incomplete, or unsuitable for a particular marketplace. You are responsible for reviewing listings before publishing them.

4. How we share information

We do not sell your personal information. We disclose information only as described in this Policy or as otherwise authorized by you.

• Service providers. We share information with vendors that help us operate the Service, such as cloud hosting, storage, authentication, analytics, error monitoring, payment processing, email delivery, customer support, security, and AI feature providers. These providers are authorized to process information only as needed to provide services to us or as otherwise permitted by law.
• Marketplaces you connect or select. When you connect a marketplace account or choose to post, sync, update, or manage a listing, we send the relevant listing content and marketplace connection information to the marketplace you selected. That marketplace’s use of your information is governed by its own terms and privacy policy.
• Payment processors. If you purchase a paid plan, payment and billing information is processed by Stripe or another payment provider we identify at the time of payment.
• Legal, security, and safety reasons. We may disclose information if we believe disclosure is necessary to comply with law, legal process, or government requests; enforce our agreements; protect the rights, safety, and property of Inky, users, or others; or detect, prevent, or address fraud, security, or technical issues.
• Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be disclosed or transferred as part of that transaction.
• With your consent. We may disclose information when you direct us to do so or otherwise give us permission.

5. Marketplace data and third-party services

The Service may allow you to connect accounts with third-party marketplaces, tools, or platforms. When you connect a third-party service, you authorize us to access, process, and transmit information as needed to provide the features you request. You can revoke marketplace connections through your account settings where available, or by contacting us.

We are not responsible for the privacy practices, security, content, rules, or decisions of third-party marketplaces or services. Review their terms and privacy policies before connecting accounts or publishing listings.

6. Where your data lives and how we protect it

We use administrative, technical, and organizational safeguards designed to protect your information. These may include encryption in transit, access controls, authentication controls, storage separation, monitoring, backups, and limits on who can access production systems.

No method of transmission, storage, or processing is perfectly secure. We cannot guarantee absolute security, but we work to protect your information and limit access to people and providers with a legitimate need to process it.

7. How long we keep information

We keep information for as long as reasonably necessary to provide the Service, maintain your account, comply with legal obligations, resolve disputes, enforce agreements, prevent abuse, and maintain security.

When you delete your account or request deletion, we will delete or de-identify personal information within a reasonable period, unless we need to retain certain information for legal, tax, accounting, security, fraud-prevention, backup, or legitimate business purposes. Copies of information may remain in backups for a limited period before being overwritten or deleted in the ordinary course.

Information that has already been sent to a marketplace or third-party service may remain subject to that third party’s own retention rules and privacy policy.

8. Your choices and rights

You may access, update, correct, export, or delete certain account information through your account settings where available. You may also contact us at [email protected] to make a privacy request.

Depending on where you live and whether applicable law applies, you may have rights to request access to personal information, correction, deletion, portability, restriction of processing, objection to processing, withdrawal of consent, or information about how we disclose personal information. Some jurisdictions may also provide the right to appeal our decision on a privacy request.

We do not sell personal information or share personal information for cross-context behavioral advertising as those terms are used under California privacy law. If our practices change, we will update this Policy and provide any required opt-out rights.

We will not discriminate against you for exercising privacy rights available to you under applicable law. However, some information is necessary to provide the Service. If you ask us to delete information needed to operate your account or provide a feature, we may no longer be able to provide that account or feature.

9. California and other U.S. state privacy rights

Residents of certain U.S. states may have additional privacy rights, subject to legal limitations and verification requirements. These may include the right to know or access the personal information we collect, the right to delete personal information, the right to correct inaccurate personal information, the right to receive a portable copy of personal information, and the right to opt out of certain types of data disclosure or targeted advertising where applicable.

10. International users

AJH Gaming and Holdings LLC, a Missouri limited liability company is based in the United States. If you access the Service from outside the United States, your information may be processed in the United States or other countries where we or our service providers operate. These countries may have privacy laws that differ from the laws where you live.

Where EU, UK, or similar data protection laws apply, we process personal information under one or more lawful bases, including performance of a contract, legitimate interests, consent, and compliance with legal obligations. Where required, we use appropriate safeguards for international transfers.

If we send marketing emails, you may unsubscribe using the instructions in the email or by contacting us. We may still send non-marketing messages about your account, transactions, security, support, or changes to our terms and policies.

12. Children

Inky is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us at [email protected] and we will take appropriate steps to delete it.
